1. Controller

The operator of AI Videographer is responsible for data processing on this website. Contact: support@aivideographer.net

2. What data we process

  • Uploaded photo and description: We use your photo and text only to create your video.
  • Generated video: The video is provided for you to watch and download. We do not publish photos or videos.
  • IP address: We do not store your IP address in plain text, only as a hash value, to enforce the limit on free videos and to prevent abuse.
  • Technical cookie: A cookie with a random identifier ("fl_gid") links your creations to your browser, so that only you can retrieve your videos and the free limit works. It contains no personal details and is not used for advertising. If you create an account, we save this identifier with it, only to count internally how free creations lead to sign-ups and purchases.

Free videos need no account. If you create an account or buy credits, we also process:

  • Account data: your email address, name and an encrypted password, plus a login cookie that keeps you signed in.
  • Google sign-in (optional): if you choose "Continue with Google", Google (Google Ireland Limited) shares your name, email address and profile picture with us so we can create or open your account. We never see your Google password. The automatic Google sign-in prompt is only shown after you click "Accept" in the cookie banner (in the EEA, the UK and Switzerland; elsewhere it is on by default, see section 5). Data may be transferred to the USA (EU-US Data Privacy Framework).
  • Credits and orders: your credit balance, credit usage and the orders you placed (product, amount, date).
  • Payments: payments are processed by Waffo, which acts as merchant of record for credit packs. We do not receive or store your card details; Waffo only tells us whether a payment succeeded.

We process account, credit and order data to provide the paid service (Art. 6(1)(b) GDPR) and keep order records as long as tax and accounting law requires (Art. 6(1)(c) GDPR). You can delete your account at any time by writing to us.

3. Purposes and legal bases

Processing your photo and description is necessary to provide the service you requested (Art. 6(1)(b) GDPR). The hashed IP address, the technical cookie and the security check serve our legitimate interest in operating the free service securely and without abuse (Art. 6(1)(f) GDPR). The cookie is technically necessary for the service (Section 25(2) TDDDG).

4. Recipients and service providers

  • AI processing: Your photo and description are sent to our AI service provider Kie.ai, which creates the video with an AI model. Uploaded files are deleted there automatically after 24 hours. Processing may take place outside the European Union.
  • Payments: Waffo (waffo.ai) processes payments as merchant of record. Waffo's own privacy policy applies to the payment data you enter there.
  • Safety check: every uploaded photo and every generated video is sent to Google (Gemini API) for an automatic safety check before it is used or shown (see our Acceptable Use Policy). If that service is unavailable, the uploaded photo is checked by OpenAI (Moderation API) instead. Only the result is used; we do not store it with your photo. Legal basis: our legitimate interest in preventing illegal and harmful content (Art. 6(1)(f) GDPR). Processing may take place outside the European Union.
  • Hosting and security check: The website is delivered via Cloudflare. To protect against automated requests we use Cloudflare Turnstile. To count visits and page load times we use Cloudflare Web Analytics, which sets no cookies, stores nothing on your device and does not create user profiles (legitimate interest, Art. 6(1)(f) GDPR).

5. Analytics

In the EEA, the UK and Switzerland, analytics and the automatic Google sign-in prompt only run after you click "Accept" in the cookie banner, as described below. Elsewhere they are on by default. You can turn them off at any time via "Cookie settings" at the bottom of every page, and we honor the Global Privacy Control (GPC) signal of your browser.

If you click "Accept" in the cookie banner, we use Google Analytics 4 (Google Ireland Limited) and Microsoft Clarity (Microsoft Ireland Operations Limited) to understand how visitors use the site, for example which pages are viewed and where the tool is hard to use. Both set cookies and process usage data such as pages visited, clicks, scrolling, device and browser type and an approximate location. Data may be transferred to the USA; both providers are certified under the EU-US Data Privacy Framework. The tool area (your photo, prompt and video) is masked and not recorded by Clarity.

Campaign links: if you arrive through a link with a campaign tag (for example from a creator's video), we note that tag (such as "youtube" or the creator's name). If you create an account, the tag is saved with your account so we can see which channel brought you and pay partner commissions. The tag is only stored in your browser (for up to 30 days) if you clicked "Accept"; otherwise it is only kept while the page is open. Saving it with your account is based on our legitimate interest in measuring our marketing channels (Art. 6(1)(f) GDPR).

The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). If you click "Decline", no analytics scripts are loaded. You can change your choice at any time via "Cookie settings" at the bottom of every page.

6. Retention

Uploaded photos are deleted after 24 hours. Records of individual creations (time, status, hashed IP address) are kept as long as they are needed for the free limit, abuse prevention and error analysis.

7. Your rights

You have the right to access, rectification, erasure, restriction of processing, data portability and objection (Art. 15 to 21 GDPR). You may also lodge a complaint with a data protection supervisory authority. To exercise your rights, contact support@aivideographer.net.

8. Photos of other people

Only upload photos you have the rights to. Photos of other people may only be used with their consent.
